Rideshare Assault

The rise of rideshare services like Uber and Lyft has revolutionized transportation, but with this convenience has come an unfortunate increase in assault cases involving passengers and drivers. If you or a loved one has been the victim of an assault while using a rideshare service in Michigan, you have legal rights and may be entitled to significant compensation. At Serling & Abramson, P.C., we understand the trauma and complexity surrounding rideshare assault lawsuits and are committed to helping victims seek justice and recover the compensation they deserve.

Rideshare assault cases present unique legal challenges, as they often involve questions of corporate responsibility, background check failures, and inadequate safety measures. Our experienced legal team has the knowledge and resources to navigate these complex cases and hold rideshare companies accountable for their role in preventing such incidents.

Types of Rideshare Assault Cases We Handle

Rideshare assault incidents can take many forms, and each case presents its own set of circumstances and legal considerations. Our firm handles a wide range of rideshare assault lawsuits, including:

  • Sexual assault by drivers: Cases where rideshare drivers assault passengers during or after rides
  • Physical assault incidents: Situations involving battery, threats, or other violent behavior by drivers
  • Passenger-on-passenger assault: Incidents where shared rides result in assault between passengers
  • Assault during pickups or drop-offs: Cases involving attacks that occur while entering or exiting rideshare vehicles
  • Kidnapping and false imprisonment: Situations where drivers take passengers to unauthorized locations
  • Robbery and theft: Cases involving drivers or other passengers who commit theft or robbery

In Michigan, rideshare assault cases often involve complex questions about the responsibilities of companies like Uber and Lyft in screening drivers and implementing safety measures. Our legal team thoroughly investigates each case to determine all potentially liable parties and build the strongest possible claim for our clients.

Common Warning Signs and Risk Factors

While rideshare companies have implemented various safety features, certain situations may increase the risk of assault incidents:

  • Rides during late night or early morning hours
  • Drivers who deviate from the designated route without explanation
  • Inappropriate comments or behavior from drivers
  • Vehicles that don't match the app description or license plate
  • Drivers who request personal information or attempt to continue contact after rides
  • Shared rides with unknown passengers in isolated areas

Rideshare assault lawsuits can be based on several legal theories, depending on the specific circumstances of each case. Understanding these legal grounds is crucial for victims seeking compensation and justice.

Negligent Hiring and Screening

Rideshare companies have a duty to conduct thorough background checks on their drivers. When companies fail to identify drivers with criminal histories, histories of violence, or other red flags, they may be liable for negligent hiring. Our investigation often reveals inadequate screening processes that allowed dangerous individuals to become rideshare drivers.

Negligent Supervision and Retention

Even after hiring drivers, rideshare companies must monitor their performance and respond appropriately to complaints or concerning behavior. Companies that ignore warning signs, fail to investigate complaints, or continue employing problematic drivers may face liability for negligent supervision or retention.

Premises Liability

In some cases, rideshare assault lawsuits may involve premises liability claims against property owners where assaults occur. This is particularly relevant for pickup and drop-off locations that may lack adequate security or lighting.

Inadequate Security Measures

Rideshare companies are expected to implement reasonable security measures to protect passengers. When companies fail to provide adequate safety features, emergency response systems, or other protective measures, they may be held liable for resulting assaults.

Pursuing rideshare assault lawsuits involves several critical steps, each requiring careful attention to detail and experienced legal representation. Our legal process is designed to protect our clients' rights while building the strongest possible case for compensation.

Initial Case Evaluation

Our legal team begins with a comprehensive evaluation of your case, reviewing all available evidence, witness statements, and documentation. We assess the strength of your claim and identify all potentially liable parties, including the rideshare company, driver, and any third parties who may have contributed to the incident.

Evidence Preservation and Investigation

Time is critical in rideshare assault cases, as important evidence may be lost or destroyed if not preserved quickly. We immediately work to secure:

  • Rideshare app records and GPS data
  • Driver background check information
  • Company policies and training materials
  • Surveillance footage from nearby locations
  • Phone records and communication logs
  • Medical records and treatment documentation
  • Witness statements and testimony

Filing Your Claim

Once we have gathered sufficient evidence, we file a comprehensive claim that outlines the legal basis for liability and the full extent of your damages. Our experienced attorneys ensure that all legal requirements are met and that your claim is positioned for maximum recovery.

Negotiation and Settlement

Many rideshare assault lawsuits are resolved through negotiation and settlement. Our legal team has extensive experience negotiating with rideshare companies and their insurance carriers to secure fair compensation for our clients. We never recommend accepting a settlement that doesn't fully address our clients' needs and losses.

Trial Preparation and Litigation

When settlement negotiations don't result in fair compensation, we are prepared to take your case to trial. Our trial attorneys have the experience and resources necessary to present compelling cases before Michigan juries and secure the justice our clients deserve.

Compensation Available in Rideshare Assault Cases

Victims of rideshare assault may be entitled to various forms of compensation, depending on the specific circumstances of their case and the extent of their injuries and losses.

Economic Damages

Economic damages represent the measurable financial losses resulting from the assault:

  • Medical expenses: Current and future costs of medical treatment, therapy, and rehabilitation
  • Lost wages: Income lost due to inability to work during recovery
  • Lost earning capacity: Reduction in future earning potential due to lasting injuries
  • Property damage: Costs to repair or replace damaged personal property
  • Transportation costs: Expenses for alternative transportation and medical appointments

Non-Economic Damages

Non-economic damages compensate for the intangible losses and suffering caused by the assault:

  • Pain and suffering: Physical pain and emotional distress caused by the incident
  • Mental anguish: Psychological trauma, anxiety, and depression resulting from the assault
  • Loss of enjoyment of life: Inability to participate in activities and experiences previously enjoyed
  • Loss of consortium: Impact on relationships with family members and loved ones

Punitive Damages

In cases involving particularly egregious conduct or gross negligence by rideshare companies, punitive damages may be available. These damages are designed to punish wrongdoers and deter similar conduct in the future.

About Us

The Serling & Abramson law firm was founded in 1970 by Michael B. Serling. Mr. Serling was the first attorney in Michigan to file a wrongful death action on behalf of the family of a mesothelioma victim. In 1975, a young widow of an asbestos insulator contacted Mr. Serling concerning her husband who had died at age 52. She was left with two young children and was trying to raise them on a $4 per hour job. The extremely gratifying feeling of success in prosecuting the case and securing a sizable settlement for the widow and her children inspired Mr. Serling to continue this work.

Michael soon realized that it was more than just asbestos insulators who were falling victim to asbestos-related diseases. It soon became apparent that mesothelioma and lung cancer were occurring in virtually every building trade and many industrial settings. He dedicated his career to securing justice for all victims affected by asbestos exposure. Today, over 50 years later, Serling and Abramson are still representing victims of asbestos-related diseases, such as mesothelioma, lung cancer, and asbestosis.
