Step 1: Legal Consultation

Legal consultations with lawyers at Serling & Abramson, P.C. are always free. You can start your consultation by calling our office or by filling out a form on our website. We will then set up a time for our experienced investigators and lawyers to meet with you. We will discuss and identify the sources of your asbestos exposure.

These conversations can be done in person, over the phone, or via Zoom. You can expect to discuss possible times and locations where the injured individual was exposed to asbestos. Often, victims do not initially recall all the sources of their asbestos exposure.

With the information gathered from these discussions, Serling & Abramson, P.C. can identify specific products the victim was exposed to and even the companies that manufactured them. We will also reference our extensive database that we’ve compiled over the last 50 years of helping similar victims with cases like yours.

Step 2: Contingency Fees

If we believe there is sufficient evidence to file a lawsuit and you wish to move forward, we will ask you to sign a contingency fee agreement which explains that, if Serling & Abramson, P.C. do not recover any money for you, there is no fee. We also don’t charge an hourly fee for our work; our firm receives only a percentage of the monetary amount we recover for you by settlement or verdict.

Step 3: The Discovery Process

Once the contingency agreement is signed and your lawsuit is filed with the court, the discovery process begins. This phase of the case is very technical and requires extensive knowledge and experience in complex asbestos litigation. Discovery involves collecting relevant medical records, asking and answering written questions (also known as interrogatories) and often includes giving spoken testimony via deposition (a sworn testimony transcribed by a court reporter that can later be used at trial).

This is the part of the process where the client will be most involved. A caring attorney from Serling & Abramson, P.C. will be present to support you through answering interrogatories and the deposition.

As our client, you will participate in the deposition — or, if the client has passed away before giving a deposition, the Personal Representative of the client’s estate will participate in their place. The information you provide in the interrogatories and discovery deposition will help the Serling & Abramson, P.C. team be successful in moving forward with your case.

Step 4: Reaching A Settlement

Once the discovery process is complete, there is an opportunity for Serling & Abramson, P.C. (on your behalf) and the company/manufacturer we’re suing to resolve the case through settlement negotiations. Prior to beginning these negotiations, our attorneys will meet with you and discuss the strengths and weaknesses of your case. At this time, our attorneys will make a suggestion regarding whether to accept a settlement or take the case to trial.

As our client, you will always retain your own authority to agree to settle or move forward with a trial. Most cases are settled before trial; however, those that do not settle will be assigned a jury trial date as the case moves toward trial.
